General Terms and Conditions \u2013 Emerson s.r.o.<\/u><\/strong><\/p>\n\n<h1 class=\"wp-block-heading\">Article 1<\/h1>\n\n<h2 class=\"wp-block-heading\">General provisions 1.1.<\/h2>\n\n<p class=\"wp-block-paragraph\">Tieto v\u0161eobecn\u00e9 obchodn\u00e9 podmienky (\u010falej len \u201eVOP\u201c) upravuj\u00fa pr\u00e1vne vz\u0165ahy, pr\u00e1va a povinnosti spolo\u010dnosti Emerson s.r.o, so s\u00eddlom Ra\u010dianska 88B, 83102 Bratislava, I\u010cO: 53\u00a0870 212, I\u010c DPH: SK2121528662, (\u010falej len \u201epred\u00e1vaj\u00faci\u201c) a jej z\u00e1kazn\u00edkov, ktor\u00fdmi s\u00fa fyzick\u00e9 osoby \u2013 nepodnikatelia, fyzick\u00e9 osoby \u2013 podnikatelia a pr\u00e1vnick\u00e9 osoby (\u010falej len \u201ekupuj\u00faci\u201c), ktor\u00e9 vnikaj\u00fa pri predaji v\u00fdrobkov a slu\u017eieb (\u010falej spolo\u010dne len \u201etovar\u201c) v kamenn\u00fdch prev\u00e1dzkach pred\u00e1vaj\u00faceho.<\/p>\n\n<h2 class=\"wp-block-heading\">1.2.<\/h2>\n\n<p class=\"wp-block-paragraph\">All contractual relationships are governed by the law of the Slovak Republic. Where the buyer is a consumer, relations not governed by these GTC are governed by Act No. 40\/1964 Coll. (Civil Code) and Act No. 250\/2007 Coll. (Consumer Protection Act).<\/p>\n\n<h2 class=\"wp-block-heading\">1.3.<\/h2>\n\n<p class=\"wp-block-paragraph\">A consumer is a buyer who is a natural person and who, when concluding and fulfilling a consumer contract, does not act within the scope of their business activity or other entrepreneurial activity.<\/p>\n\n<h2 class=\"wp-block-heading\">1.4.<\/h2>\n\n<p class=\"wp-block-paragraph\">A buyer who is not a consumer is an entrepreneur who purchases goods for the purposes of their business. This buyer is governed by the Commercial Code.<\/p>\n\n<h2 class=\"wp-block-heading\">1.5.<\/h2>\n\n<p class=\"wp-block-paragraph\">The seller is a person who, when concluding and fulfilling a consumer contract or other contract, acts within the scope of their business activity or other entrepreneurial activity.<\/p>\n\n<h1 class=\"wp-block-heading\">Article 2<\/h1>\n\n<p class=\"wp-block-paragraph\">Purchase contract concluded at a physical location<\/p>\n\n<h2 class=\"wp-block-heading\">2.1.<\/h2>\n\n<p class=\"wp-block-paragraph\">The contractual relationship between the seller and the consumer buyer is defined by the relevant provisions of Act No. 40\/1964 Coll. (Civil Code) and Act No. 250\/2007 Coll. (Consumer Protection Act), as amended.<\/p>\n\n<h2 class=\"wp-block-heading\">2.2.<\/h2>\n\n<p class=\"wp-block-paragraph\">Where the buyer is a consumer, the offer to conclude a purchase contract is the placement of the goods offered by the seller on the market, and the purchase contract is concluded at the moment the seller accepts the consumer&#8217;s order.<\/p>\n\n<h2 class=\"wp-block-heading\">2.3.<\/h2>\n\n<p class=\"wp-block-paragraph\">Predaj tovaru spotrebite\u013eovi na z\u00e1klade k\u00fapnej zmluvy v kamennej prev\u00e1dzke podlieha pr\u00e1vnej \u00faprave z\u00e1kona \u010d.40\/1964 Z. z. a ustanoveniam z\u00e1kona \u010d. 108\/2024 Z.z. v zmysle ods. 1.2. pri\u010dom sa primerane pou\u017eij\u00fa ustanovenia t\u00fdchto VOP. Emerson s.r.o, so s\u00eddlom Ra\u010dianska 88B, 83102 Bratislava, I\u010cO: 53\u00a0870 212, I\u010c DPH: SK2121528662 Tel.: +421 \/ 0902 071\u00a0772 E-mail: info@stkcity.sk www.stkctiy.sk.Spolo\u010dnos\u0165 opr\u00e1vnen\u00e1 na technick\u00e9 a emisn\u00e9 kontroly vozidiel<\/p>\n\n<h2 class=\"wp-block-heading\">2.4.<\/h2>\n\n<p class=\"wp-block-paragraph\">Where the buyer is not a consumer under clause 1.4 of these GTC and does not have an individual contract with the seller, the purchase contract is concluded at the moment the seller confirms the order.<\/p>\n\n<h1 class=\"wp-block-heading\">Article 3<\/h1>\n\n<p class=\"wp-block-paragraph\">Distance contract and Off-premises contract<\/p>\n\n<h2 class=\"wp-block-heading\">3.1.<\/h2>\n\n<p class=\"wp-block-paragraph\">The contractual relationship between the seller and the consumer for sales under a distance contract or an off-premises contract is governed by Act No. 108\/2024 Coll.<\/p>\n\n<h2 class=\"wp-block-heading\">3.2.<\/h2>\n\n<p class=\"wp-block-paragraph\">Where the buyer is a consumer, the offer to conclude a contract is the placement of the goods offered by the seller in the catalogue. The contract is concluded at the moment the seller confirms the consumer&#8217;s order.<\/p>\n\n<h2 class=\"wp-block-heading\">3.3.<\/h2>\n\n<p class=\"wp-block-paragraph\">Where the buyer is not a consumer under clause 1.4 of these GTC, they are governed by the commercial terms to the extent applicable.<\/p>\n\n<h1 class=\"wp-block-heading\">Article 4<\/h1>\n\n<p class=\"wp-block-paragraph\">Product prices<\/p>\n\n<h2 class=\"wp-block-heading\">4.1.<\/h2>\n\n<p class=\"wp-block-paragraph\">The seller states the prices of goods at physical locations in valid and publicly available price lists pursuant to Section 6 of the relevant Act. Prices are listed inclusive of VAT.<\/p>\n\n<h1 class=\"wp-block-heading\">Article 5<\/h1>\n\n<p class=\"wp-block-paragraph\">Payment for goods<\/p>\n\n<h2 class=\"wp-block-heading\">5.1.<\/h2>\n\n<p class=\"wp-block-paragraph\">The seller offers the consumer the following payment methods at physical locations: 5.1.1. cash; 5.1.2. payment card; 5.1.3. other agreed methods.<\/p>\n\n<h2 class=\"wp-block-heading\">5.2.<\/h2>\n\n<p class=\"wp-block-paragraph\">Upon payment under clause 5.1., the seller undertakes that at the moment of payment, the buyer acquires the right to the goods, which are immediately handed over.<\/p>\n\n<h2 class=\"wp-block-heading\">5.3.<\/h2>\n\n<p class=\"wp-block-paragraph\">Ak kupuj\u00facim nie je spotrebite\u013e, platobn\u00e9 podmienky si s pred\u00e1vaj\u00facim dohodne v individu\u00e1lnej zmluve, ktor\u00e1 m\u00e1 prednos\u0165 pred t\u00fdmito VOP. Spolo\u010dnos\u0165 opr\u00e1vnen\u00e1 na technick\u00e9 a emisn\u00e9 kontroly vozidiel.<\/p>\n\n<h1 class=\"wp-block-heading\">Article 6<\/h1>\n\n<p class=\"wp-block-paragraph\">Withdrawal from a Distance Contract or Off-premises Contract<\/p>\n\n<h2 class=\"wp-block-heading\">6.1.<\/h2>\n\n<p class=\"wp-block-paragraph\">The seller follows the provisions of Act No. 108\/2024 Coll. upon withdrawal by the consumer from the contract.<\/p>\n\n<h2 class=\"wp-block-heading\">6.2.<\/h2>\n\n<p class=\"wp-block-paragraph\">Where the buyer is not a consumer, the right of withdrawal is governed by Act No. 513\/1991 Coll. (Commercial Code) and applies only in cases where this is permitted by law.<\/p>\n\n<h1 class=\"wp-block-heading\">Article 7<\/h1>\n\n<p class=\"wp-block-paragraph\">Booking a service appointment<\/p>\n\n<h2 class=\"wp-block-heading\">7.1.<\/h2>\n\n<p class=\"wp-block-paragraph\">The seller provides the buyer with the option to book an appointment for the provision of a service (performance of a technical inspection, emissions inspection or related service) in advance.<\/p>\n\n<h2 class=\"wp-block-heading\">7.2.<\/h2>\n\n<p class=\"wp-block-paragraph\">A valid booking is evidenced by a confirmation SMS or email message delivered to the buyer immediately after completing the booking.<\/p>\n\n<h2 class=\"wp-block-heading\">7.3.<\/h2>\n\n<p class=\"wp-block-paragraph\">If the buyer is more than 10 minutes late for the booked appointment, the seller is entitled to cancel the appointment and the buyer will need to rebook.<\/p>\n\n<h1 class=\"wp-block-heading\">Article 8<\/h1>\n\n<p class=\"wp-block-paragraph\">Personal data protection \u2013 information for data subjects pursuant to Article 13 of the General Data Protection Regulation (GDPR)<\/p>\n\n<h2 class=\"wp-block-heading\">8.1.<\/h2>\n\n<p class=\"wp-block-paragraph\">The seller undertakes that the buyer&#8217;s data, acquired and processed for the purpose of concluding a contractual relationship for the sale of goods, will be handled in accordance with Act No. 18\/2018 Coll. on personal data protection.<\/p>\n\n<h2 class=\"wp-block-heading\">8.2.<\/h2>\n\n<p class=\"wp-block-paragraph\">The purpose of processing personal data is the conclusion and performance of the subject matter of the contract.<\/p>\n\n<h2 class=\"wp-block-heading\">8.3.<\/h2>\n\n<p class=\"wp-block-paragraph\">The legal basis for processing personal data pursuant to Article 6(1)(b) of the Regulation is the pre-contractual and contractual relationship.<\/p>\n\n<h2 class=\"wp-block-heading\">8.4.<\/h2>\n\n<p class=\"wp-block-paragraph\">The seller undertakes to use personal data solely for the purpose for which it was collected; it will not disclose, make available or transfer it to third parties, except to the extent required by law.<\/p>\n\n<h2 class=\"wp-block-heading\">8.5.<\/h2>\n\n<p class=\"wp-block-paragraph\">The buyer has the right to request access to their personal data from the seller pursuant to Article 15 of the Regulation and to object to processing pursuant to Article 21 of the Regulation.<\/p>\n\n<h2 class=\"wp-block-heading\">8.6.<\/h2>\n\n<p class=\"wp-block-paragraph\">Pred\u00e1vaj\u00faci bude sprac\u00fava\u0165 osobn\u00e9 \u00fadaje iba po\u010das doby trvania \u00fa\u010delu a v rozsahu nevyhnutnom na splnenie \u00fa\u010delu ich sprac\u00favania. Po skon\u010den\u00ed \u00falo\u017enej doby bud\u00fa zlikvidovan\u00e9. 8.7. Kupuj\u00faci sa m\u00f4\u017ee obr\u00e1ti\u0165 so svojimi ot\u00e1zkami oh\u013eadom spracovania jeho osobn\u00fdch \u00fadajov na pred\u00e1vaj\u00faceho p\u00edsomne na adresu jeho s\u00eddla alebo zaslan\u00edm e-mailu na adresu <a href=\"mailto:info@stkcity.sk\">info@stkcity.sk<\/a>.<\/p>\n\n<h1 class=\"wp-block-heading\">Article 9<\/h1>\n\n<p class=\"wp-block-paragraph\">Final provisions<\/p>\n\n<h2 class=\"wp-block-heading\">9.1.<\/h2>\n\n<p class=\"wp-block-paragraph\">The supervisory authority is the Slovak Trade Inspection, Inspectorate SOI for the Bratislava Region (Bajkalsk\u00e1 21\/A, P.O. Box 5, 820 07 Bratislava 27).<\/p>\n\n<h2 class=\"wp-block-heading\">9.2.<\/h2>\n\n<p class=\"wp-block-paragraph\">Liability for defects in goods or services is governed by the Complaints Procedure of the company, which forms an integral part of these GTC.<\/p>\n\n<h2 class=\"wp-block-heading\">9.3.<\/h2>\n\n<p class=\"wp-block-paragraph\">The provision of technical and emissions inspection services is subject to the personnel and capacity constraints of the facility. The seller reserves the right to refuse or reschedule a booking in justified cases.<\/p>\n\n<h2 class=\"wp-block-heading\">9.4.<\/h2>\n\n<p class=\"wp-block-paragraph\">These GTC come into effect on 01.01.2026.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>GTC.
